No tourist tax in Madrid, Seville or Malaga? You still have to register guests with SES Hospedajes

As of 2026, Madrid, Seville, and Malaga charge no tourist tax. Every short-term rental host in Spain must still register guest data with SES Hospedajes, the national guest registration system operated by the Secretaría de Estado de Seguridad under Real Decreto 933/2021, within 24 hours of check-in. Failing to register carries fines of up to €30,000. Tourist tax and guest registration are separate obligations, and the absence of one has no effect on the other.


Does Madrid, Seville or Malaga have a tourist tax?

No. As of 2026, Madrid charges no tourist tax, and neither does Seville, Malaga, or anywhere else in Andalusia. Hosts in these cities do not collect anything from guests on behalf of the municipality. Proposals come up regularly, and Malaga and Seville have both discussed introducing a levy, so this can change. For now there is nothing to collect.

Do I still have to register guests if my city has no tourist tax?

Yes. Tourist tax is a fiscal matter collected for the local authority. Guest registration is a public security matter governed by national law and enforced by national authorities. They are separate laws administered by separate bodies. A host in Madrid with no tourist tax obligation has exactly the same guest registration obligation as a host in Barcelona.

This is the assumption that costs hosts money. No tourist tax in your city does not mean no compliance obligations, because registration is reported to national authorities, not municipal ones.


What is SES Hospedajes?

SES Hospedajes is Spain's national guest registration platform, introduced by Real Decreto 933/2021 and in force since 2 January 2023. It is operated by the Secretaría de Estado de Seguridad and applies to short-term rentals in every autonomous community, every city, and every neighbourhood, regardless of the local tourist tax situation.

One regional nuance: in Catalonia and the Basque Country, guest data is submitted to the regional police systems, Mossos d'Esquadra and Ertzaintza respectively. The registration obligation itself is the same everywhere. Only the receiving system differs.


What data do I have to submit and by when?

For each guest aged 14 and over, you must submit their full name, date and place of birth, nationality, document type and number, document issue date, and document expiry date. For children under 14, the accompanying adult provides the child's details and declares their relationship to the child. You must also submit booking data: arrival and departure dates, number of guests, price paid per night, and payment information including the payment method and payment date.

The deadline is 24 hours from check-in, for every booking, every time.


What are the fines for not registering guests in Spain?

Non-compliance carries fines of up to €600 for incomplete or late submissions and up to €30,000 for failing to submit at all. Enforcement is carried out by the Guardia Civil. Because registration reports to national authorities, hosts in cities without tourist tax are just as visible to inspectors as hosts in Barcelona.


Does Airbnb register my guests for me?

No. Under Real Decreto 933/2021, platforms like Airbnb and Booking.com report their own reservation data to the authorities, but the legal duty to register each guest's identity data with SES Hospedajes sits with the host. A confirmed booking on a platform does not satisfy your registration obligation. You, or a tool acting on your behalf, must collect the guest data and submit it.
